Apple wins class action lawsuit

Tech giant Apple has won a class action lawsuit in the US, which attempted to take down the company for allegedly causing hearing loss.

The suit, which was filed by Joseph Birdsong and Bruce Waggoner, said the iPod device was defective and that it could cause significant hearing damage. The two said the device “is defective because it poses an unreasonable risk of noise induced hearing loss”.

“The plaintiffs simply do not plead facts showing that hearing loss from iPod use is actual or imminent,” the San Francisco headquarters of the US Court of Appeals said in its decision last month.

“The iPod has an ‘ordinary purpose of listening to music’ and nothing they allege suggests iPods are unsafe for that use or defective.”
