Samsung has won an intellectual property ruling in Britain after Apple accused the company of ripping off its iPad tablet, after a judge ruled the Galaxy tablet isn’t “cool” enough to be mistaken for the iconic device.
Judge Colin Birss said in a ruling that consumers weren’t likely to get the two confused.
He noted the tablets “do not have the same understated and extreme simplicity which is possessed by the Apple design”.
“They are not as cool.”
The case is similar to those being heard across the world, as Apple attempts to stop Samsung from selling its Galaxy tablet.
In a statement, Samsung reaffirmed its position the tablet doesn’t infringe on any of Apple’s IP.
“Should Apple continue to make excessive legal claims in other countries based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited,” the company said.
